A federal judge temporarily halted major parts of the Agriculture Department’s reorganization plan, including the planned closure or consolidation of the Beltsville Agricultural Research Center in Maryland. U.S. District Judge Vince Chhabria issued the October 13 stay under Section 705 of the Administrative Procedure Act.
The order bars USDA from closing or consolidating Agricultural Research Service laboratories and facilities, relocating their employees or functions outside local commuting areas, and carrying out similar actions in the Forest Service and several other components. It permits certain moves within the National Capital Region and does not require employees who began work at a new duty station before September 14 to return.
Chhabria found that the plaintiffs were likely to succeed in arguing that USDA was using appropriated funds for reorganization activities Congress had restricted. The department told Reuters that it was reviewing the decision and would respond in court.
